Terms of Service for AQUA Coaching
1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the services, products, and information provided by AQUA Coaching ("we," "us," or "our") through the website aquacoachinghub.com and any coaching sessions, materials, or programs offered.
By booking a session or accessing our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.
2. Coaching Services and Disclaimer
A. Nature of Coaching
You acknowledge that career transition coaching is a partnership focused on helping you identify and achieve your professional goals. Coaching is designed to be thought-provoking and inspirational. It is not, and is not a substitute for, legal advice, financial advice, medical diagnosis, therapy, or counseling.
B. Client Responsibility
You are solely responsible for the creation and implementation of your own career, life, and financial decisions and results. You agree that we are not responsible for any outcomes, positive or negative, that may result from our coaching services.
C. No Guarantee
We offer no guarantee, promise, or warranty that you will obtain a specific result, achieve a particular goal, or secure employment as a result of using our services. Our comments about potential outcomes are expressions of opinion only.
3. Payment, Fees, and Cancellation
A. Fees and Payment
All fees for coaching services are confirmed in a separate written agreement. Payment is required in advance of services rendered, unless otherwise agreed. The method of payment is agreed upon at the discovery session and part of a separate agreement.
B. Cancellation and Rescheduling (Sessions)
You must notify us at least 24 hours in advance if you need to cancel or reschedule a one-on-one session.

Cancellations or no-shows with less than 24 hours' notice will result in the forfeiture of that session's fee.

We reserve the right to reschedule or cancel any session due to unforeseen circumstances and will provide you with reasonable advance notice where possible.
C. Refund Policy (Programs/Packages)
All fees for coaching packages, programs, and digital products are refundable within 7 days of purchase. Specific refund terms for packages or programs will be clearly outlined in the service agreement provided at the time of purchase.
4. Intellectual Property and Confidentiality
A. Intellectual Property (IP)
All materials provided by us, including but not limited to, workbooks, guides, templates, website content, and session recordings (if applicable), are our proprietary intellectual property.

You may use these materials for your personal, non-commercial use only.

You may not copy, reproduce, distribute, or share these materials with any third party without our express written permission.
B. Client Confidentiality
We agree to keep all information you share with us confidential, subject to the following exceptions:

When required by Swiss law or court order.

When we believe the information indicates an immediate risk of harm to yourself or others.

When you have given express written permission to share your information.
5. Governing Law and Jurisdiction (Switzerland)
These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.
You agree that any disputes arising under or relating to these Terms will be subject to the exclusive jurisdiction of the competent courts located in Canton of Vaud, Switzerland.
6. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide you with reasonable advance notice of any material changes. By continuing to use our services after those changes become effective, you agree to be bound by the revised Terms.
